Regular Terms and Conditions (Basitglobal.com)

For the ease of our clients, we are offering three types of Air Conditioning Annual Maintenance Contracts (AMC), which are as follows:

  • AMC Option – 1 – ‘All Spare Parts by Client, ‘Spare Parts shall be supplied by the Client and fixed by us. Refrigerant Gas shall be charged at AED 50/- Per TR. Under this Option, we shall carry out a minimum of THREE AMC Services (AC Equipment Only). We offer a 7-day warranty for replaced parts if we supply the Spare Parts.

 

  • AMC Option—2 – ‘Limited Spare Parts by Client’: All Spare Parts shall be supplied by Basit except Compressors, Motors, and PCB/Thermostats. Under this AMC Option, we shall carry out a minimum of FOUR AMC Services (AC Equipment Only). We offer a seven-day warranty for the parts replaced if the Spare Parts are purchased from us.

 

  • AMC Option – 3 – ‘All Spare Parts by Basit’ all Spare Parts shall be supplied by Basit, including Compressors, Motors, and Thermostats. Under this AMC Option, we shall carry out a minimum of SIX AMC Services. (AC Equipment Only).

 

Note: The minimum value of any AMC Agreement shall be AED 2,000/- irrespective of equipment quantity.

  1.  It will be the prerogative of the Basit Service Engineer to assess and decide the additional number of Preventive Maintenance Services as per machine condition, irrespective of the offered services in the above AMC Options.

 

  2.  Our rates are for Repairs and Maintenance only; for any Expansion, Modification, or Making of a New Item not in our scope, a separate quote shall be submitted if required.

 

  3.  Any Item damaged due to calamity, the act of God, natural deterioration, etc., is not in our scope.

 

  4.  Under the AMC Option ‘3’ of ‘Supply of Spare Parts,’ we shall first repair and re-condition all the significant parts such as Compressors, Motors, Blowers, Fan Blades, etc. New spare parts shall only be supplied if the spare parts are beyond repair.

 

  5.  Equipment covered under this contract is as per the attached Quotation/Agreement or the Equipment Tag List (ETL) jointly signed by both parties. The equipment Tag List shall be prepared once the contract is signed. The final quantity shall be as per ETL.

 

  6.  We will carry out free-of-cost repairs such as Touch-up Paints, False Ceiling, Tiling, Carpentry, etc. The area shall be at most one square meter for a single attempted repair at each spot. If the Client wishes more work, we can supply the workforce at AED 200/- per person per eight hours (minimum of two persons to hire). The Client shall provide all materials; we offer a seven-day warranty for the parts replaced if we supply the Materials.

 

  7.  Free Repairs shall be considered null and void if all the AC Units are not in our scope of the concerned Premises, Offices, Villas, Apartments, etc. In the case of Restaurants/Kitchens, all the Air Conditioners and Freezers must be included in our Contract.

 

  8.  When the situation arises, we shall be allowed to take over the AC Units or the other equipment to our workshop or service center.

 

  9.  Breakdown Calls shall be attended to within 24 to 48 hours on working days, from 10 AM to 6 PM. Breakdown calls shall be chargeable on Sundays and Holidays at AED 100/- Per Visit. We will conduct Preventive Maintenance between 2 PM and Midnight. Express Services can be availed by paying an extra amount. Under ‘Express Services Contract (ESC),’ the Breakdown will be attended to within six hours, 365 days. One Time Express Service Charges shall be 150/- per visit.

 

  10.  A maximum of Ten On-Call Visits shall be given a year, excluding AMC Services. Each visit shall be no more than 6 Man-Hours on the same day; the driver will also be considered part of a team. AED 100/- shall be Charged for Additional each Visit.  During Preventive Maintenance Service Calls, no other equipment repairs shall be carried out if required; that repair will be considered one visit. Our offer is based on a ‘one visit, one repair’ basis.

 

  11.  It is the prerogative of Basit to decide the type of services (Dry or Wet) for a particular machine that may be required at that time. If Over-Hauling requires dismantling the AC Unit, that should be charged separately.

 

  12.  All the machines must be in running condition before the contract comes into existence. If any Unit is nonfunctional, Basit shall submit its separate quote for repairs, which shall be paid in addition to the AMC charges. Once all AC Units are in working condition, the AMC will be initiated upon signing the Equipment Tag List (ETL).

 

  13.  The Maintenance Service Contractor is subject to termination by Basit if a third party carries out any repair work without our consent on the contracted equipment.

 

  14.  Basit can terminate the maintenance service contract in case of a change of ownership.

 

  15.   Basit shall not be liable for breach of non-performance or delays in carrying out any obligations mentioned in the Contract due to any unwarranted situation imposed by the Government, any act of God, or War conditions arising from similar causes beyond the contractor’s control.

 

  16.  Repairs of any equipment shall be at the discretion of Basit only. Only Basit can decide whether the equipment or part is repairable or not. We will adopt an honest approach while determining equipment life expectancy; any equipment beyond repair shall be notified to the Owner.

 

  17.  M/s. Basit has all the rights to shoot videos or photos of the equipment and premises under their Contractor, which shall be used to prepare Pre-Qualification on their website. M/s. Basit assures all our Clients that we will never share personal information without the consent of our Clients.

 

  18.  If any equipment needs preventive maintenance, we will notify the Client, and the Client mustn’t ignore our request; if we are not allowed to perform our duties, the Client is responsible for any consequential damages.

 

  19.  On every visit, the Client must sign our ‘Field Survey Report’ (FSR), whether the job is completed or not. If the job is not completed due to our reasons, the Client can select the ‘Work Solution’ tick box on our FSR Form. If the ‘Work Solution’ Box is ticked, ‘Visit’ won’t be counted.

 

Payment Terms:

 

  1. The Agreement shall exist when both parties sign the contract and make payments. One CDC and one PDC of five months shall be accepted for more than five thousand. If the Contract Amount is below five thousand, Cent percent payment shall be made in Advance. All spare parts payments and visit charges shall be made cent percent cash in Advance.

 

  2. The client has the right to terminate this contract with one month’s notice if the contractor fails to perform his obligation under the agreement to the client’s complete satisfaction. Second Party (Basit) is liable to get 33.33% of the Contract Value for each service. The Contract shall remain intact if neither party terminates it officially with one-month prior notice.

 

  3. The ‘Contract Value’ is for the abovementioned units; any additional AC Units shall be charged separately. Basit has the right to refuse breakdown calls; if any payment is pending, all the costs must be paid in advance.

 

4. Basit shall not be responsible for any breakdown during non-payment. For AMC Options – 2 & 3, the repair cost of breakdown equipment shall be borne by the First Party. All the payments must be in cent percent Advance.

 

Exclusions:

 

  • All IT and Computer related works, or machinery with Microprocessors other than Air Conditioning equipment, are not in our scope. Commercial/Industrial Equipment such as Cold Storage, Chillers, Conveyor Systems, Fans/Pumps, MDBs, and SMDBs are also not in our scope if they are not explicitly mentioned in our Offer. If required, a separate quote shall be submitted.
  • Our scope is limited to the repairs and servicing of equipment/system; other than fixing spare parts for repair purposes, any item that needs to be fixed in full, such as removal and re-fixing of old equipment, piping, cabling, lighting, switch gears, any wooden structure, or all such things are not in our scope. If needed, it will be charged separately.
  • Any spar part/device/accessories that are in working condition but the Client wishes to replace out of his own will shall be on a chargeable basis.
  • Replacement of fused bulbs and filaments is not in our scope.
  • Free Supply of Spare Parts under ‘AMC Option-2 & 3’ is only for Air Conditioning Units; the rest of the Equipment and Services shall be charged separately, including Electrical, Plumbing, Carpentry, False Ceiling, Painting, and Other Services.
  • Under spare parts supply ‘AMC Options 1 & 2’, it is the prerogative of the Client to supply the spare parts, but those spare parts must be provided immediately before the Team is demobilized. If the Team is demobilized and mobilized again, that shall be counted as two ‘Visits.’
  • The supply of equipment bodies such as Outer Panels/Boxes, Base Plates, Condenser Coils, Evaporator Coils, Fins, etc., are not in scope for all the AMC Options.
  • Day-to-day operation and running of the Plant and Equipment are not in our scope.
  • Any damage due to outdoor weather conditions such as depletion/damage to condenser coil due to hail storm/rain and rusting, etc.
  • AC Scope starts from the Outdoor Unit Electrical Isolator; Isolators are to be provided by the Electrical Contractors. AC Drain Scope is limited until the P-Trap after the P-Trap Plumbing Contractor’s Scope starts. Any alteration of electrical work, such as cabling, wiring, switchgear, etc., is not in our scope.
  • We will clean and dispose of the garbage or trash related to our job in the trash bin of the Client. Cleaning of grills, diffusers, ducts, drainage systems, sump pits/manholes, water tanks, etc., is not in our scope. Carting-away of disposable materials is also not in our scope. If required, it shall be charged separately.
  • Any other work not explicitly mentioned above.
  • Free Water and Electricity to be provided by the Client. The water source has to be within the limit of 10m from the AC Unit—scaffolding/Ladder to be arranged and erected by others.
  • Cleaning of the Kitchen Stack/Riser, Chimney, or Ecology Unit is not in our scope.
  • Un-shelving and Shelving of goods and other Clients’ belongings to be done by others, not by Basit.
  • Deep Cleaning of any sort on the space worked or otherwise not in our scope; only the waste materials related to the job will be removed by us.
  • The Client shall provide free-of-cost Parking for our supervisor’s and maintenance vehicles.
  • The Client shall provide and pay for all gate passes, permits, or third-party inspections.
